I cant believe all the Rangers fans that are saying that Duff and Phelps are at it for not accepting TBK as preferred bidders. D&P have a legal obligation to accept the bid that provides the best deal for the CREDITORS! Do you honestly think that they would be acting on behalf of their old pal Craig Whyte and rejecting bids that would provide a better return for the creditors when they will be open to criminal proceedings if they are found not to have acted in the best interests of the creditors?

The Blue Knights did not put up enough money. Period. If Kennedy was so desperate to save Rangers he could comfortably match what the preferred bidder is offering. He wont.

He wont do that and the reason he wont is because TBK are just posturing and grandstanding without any intention of saving the current incarnation of the club. They are waiting to pick up a Zombie FC NewCo but be able to say 'oh but we tried so hard to save RFC 1872 so let us run RFC 2012'

I did post on here months ago that all the bidders were making all the right noises but were really just vultures circling ready to pick clean the bones of the corpse.

Correct. They do have a duty to achieve the best deliverable deal to the creditors, but you missed the key word...."deliverable".

If Kenedys CVA experts are correct, they need to begin the process now to enable the club to exit administration successfully...

To the OP - you are correct D&P are duty bound to look after the Creditors best interest but the key word in Kennedy's statement tonight - and the one thing D&P have failed to respond to in this childish managing match is "deliverable"....

My personal view - and I hate to be pessimistic - is that Kennedy and TBK offer IS deliverable whereas others will ultimately prove not. That will be the failing of D&P who seem very naive and pacing more emphasis on who can offer the most cash.

At this stage in the game, any "real player" can prove they have the finances but that does not necessarily mean they will follow through after due diligence. I fear we will see a repeat of the Miller fiasco and as a consequence RFC will be liquidated.

Liquidation arguably will deliver a higher pence in the pound settlement to Creditors, but as Administrators D&P DO have a responsibility to keep a business as a Going concern if they feel it can be turned around.

DD by any other party othe than BK/TBK could take at least 2 to 3 weeks. If at that end of that period the preferred bidder des not proceed, the game is over. That is a hell of a roll of the dice by D&P at this late stage in the game 'cause surely to God even they know if they call the preferred bidder wrong (again) there is no fall back next time around!

To me - and in the best interests of both the Creditors - and in the best interests of keeping RFC as a going concern, they should be placing equal emphasis on the likelihood to deliver by the bidders. To tat end, D&P need to do their own due diligence on all parties at the table and not just be swayed by who is offering the most cash.

Something tells me D&P will not be that thorough!

Mac not bang on. If D and P refused TBK because they refused to pay an unconditional 500,000, then why did the accept an unconditional bid from Bill miller. Also the bids are so close that there would be no criminal proceedings no matter who they choose. Too many unusal things happening with this mob for me. Oh last but not least Mac explain why so called expierenced administrators forgot to fill in the paper work to say they would be the administrators of Rangers. You can buy rangers (lock, stock and barrel) for somewhere in region of £15 million at the moment.....

or wait till liquidation and maybe get it all for say £1 million....

This is the nightmare for distressed business, yes lots of people say they interested and look at the books, but usually no-one want to buy the company (and its debts) - they just wait for liquidation (where debts are cancelled) and then buy the goods at bargain basement prices..

second nightmare is that with players rangers worth maybe £20 million + , but if the players walk (and did they not benefit from EBT??) they can kill the club a second time if ranger get no money from them leaving

rangers squad may be worth £10 million at present - if sold en masse to an english club, but if they walk after liquidation - thats £10 million more that rangers FC just lost!!!

some people got double pay (no tax at 50%) and now may take millions more away from the club..... watp ??

I could come up with a deal that is about as useful as the Blue Knights bid right now: The change out of my back pocket up front and then all the proceeds from when Rangers win the champions league.

Absolutely the bid has to be deliverable but I reckon a firm of highly trained insolvency practitioners would probably ba able to spot which deal is better than average Joes like me and you.

Kennedy and Murray are just trying to build up a stock of goodwill with the Rangers fans. Whether it is because they want to run a Newco or for some other reason I dont know but they are more than capable of submitting an acceptable, deliverable bid.

Why did D&P accept Bill Miller's bid then?
TBK's offer was only £200,000 less.
How do you know what the other bidders offer is?
They haven't even done the due diligence yet?
Would you buy a 2nd hand car before lookin over it first?
They've only been on the scene for 48 hours,so if they have done the due diligence,seen the books, and made an offer in 48 hours,then something's not right,and that's my point.
BM's bid was a bluff,to make it look like D&P were willing to do a deal. They weren't,and that is now blatantly obvious.

D&P rejected the Blue Knights bid because the creditors would be worse off with their bid than they will be with liquidation. Their bid was nowhere near what Miller had on the table and when it was broken down yesterday by Whitehouse it was showed up as a pittance. Also the fact that TBK were factoring European revenue into their offer should highlight that these guys are not a serious option.

Admins did have a screw up not filing the paperwork properly but they are probably not familiar with the paperwork aspects of the Scottish legal system. No Scottish firm would take on the RFC administration because of the danger to their windows. There is no way any insolvency practice would be doing anything other than acting in a proper lawful manner in a case with this level of scrutiny.

As a tax payer and therefore one of your creditors why do you think we should accept roughly ten pence in the pound when your assets, pkayers land buildings name etc, would bring in maybe at least 50p in the pound. the harsh reality isthat its the creditors saying no to these bits. anthing less than a 50 million offer should be rejected. we, your creditors, want our cash back your football team's existenxe is of no concern. welcome to the real world.

Look closely at the offer the BK are offering next to nothing in terms of money for the creditors! it does'nt matter who takes over the day to day running cost's alone are unsistanable as you are currently £1m a month in the red, so how are you going to pay your current & mounting debts? as you can forget about any cva because that will clearly not happen at the pittance on offer.

So Friday has been and gone and all we have is the name of an ex-Sheffield Utd director and a slagging match between Duff & Phelps and TBK's. Kennedy made alot of sense on SSN tonight and he was very passionate and I would be more inclined to believe what he says over these administrators. We need answers and we need them now, but I already fear its too late and we are gone, especially since CW needs to find £30m from somewhere or declare himself bankrupt, this whole period of administration stinks and somebody needs to answer these crooks who have been running our club, they seem to have made a bad sitation worse .......... Think about what your saying. the reason your not getting answers is the fact tht to let light into the dark and murky dealing that have been going on will destroy any chance of a buy out. The reason for the delay is the back dealing about who wilkl pay whom, how much over what period. Thats what killed the TBK offer to much was dependant on playing games in the future and the presumtion that we will qualify for Europe in years 2, 3, and 4. Letter sent to David Whitehouse of Duff and Phelps by David Hinchcliffe a partner at Walker Morris. Brian Kennedy has asked me to share this with you and you are more than welcome to print it/read it out/broadcast it.
This email completely condemns the Administrators and we are asking WHY are they doing this?

David I note you have not yet replied as promised in your email below please respond as soon as you can.
Regarding your recent press announcement ..".you were advised there was not agreement within the consortium about the funding of the bid" ....please let me know who apparently advised you of this as this is wholly inaccurate and on no occasion has anyone contacted either myself or Brian to state this is a worry.
Further to state that amounts were included in the offer for playing in europe next season when it can't be achieved is completely inaccurate as the actual offer is for increasing the consideration in seasons 2 and 3 if they played in europe .
Further to state that the offer should be reduced by 3.5 m because these are debts due to the company is also misleading as 2.4 million of this sum is payable in the next few weeks as per Brians earlier email and will be used as cashflow for the trading losses of the club.
You completely fail to state our client had agreed to fund the huge trading losses post June 1st and picked up liabilities for 3.6 m of football creditors ... tupe liabilities ...debenture holders etc making a cash payable of 9.1m. plus trading losses prior to completion and European add ons together with other liabilities. You seem to be continually comparing the quantum of my clients bid against bids such as the Miller bid which are not real .
As you know I have vast experience of people making bids for insolvent football clubs ....I cannot see how any of these new parties can be making real bids when they have done no real due diligence ....proof of funds may have been provided but it does not make sense to me why investors would invest in Rangers without full due diligence by them and I would strongly recommend that full due diligence is carried out by you on these parties as there is no time to have another Miller situation .
Finally regarding your comment that Brian wanted to be the last man standing. In mine and Brians view he is as we don't believe the other bidders will complete
If you want to talk to find a way to save this great club Brian has said his phone will be on this evening otherwise I fear it will be too late David

HMRC will not agree to a CVA where preferential creditor status is given to unsecured fooball debts. You can not pick and choose which creditors you wish to pay, the SFA does not operate a football creditors rule unlike England and Wales. The 3.6 million owed to other fooball clubs must be included in the ordinary creditors list or the CVA has no chance of success. The TUPE and denture debts are differen as they are secured.

According to "jsm" on this site I posted the most accurate summary to date. Continuing in this spirit I would like to comment on those claiming this "email" is fake. David Swanton is the media advisor and spokesman for BK and TBK. This "email" was read out live on SSN, the BBC and online media outlets. The above "email" was a draft before it was finally released to the media. I am keenly aware this is a "rumours" site however I don't believe even the "meedja" in Succulent Scotland are that gullible, even thick to print or report live a "fake" email. Oh, and D&P confirmed through the usual media channels they had received the aforesaid email. Sources can be dodgy but a spot of "due diligence" pardon the pun, takes no time.

No way, no matter how friendly the terms are between businessmen/women, would an 'official' letter be sent of this standard. Particularly from a supposed 'partner' of a firm! PLEASE! A summary of today's events: D&P announce 2, no 3, hold on was it 4 bids on the table? TBK deadline of midday passed, bid was removed/rejected/torn up/ made into paper aeroplane... Delete as appropriate...TBK press conference makes clear their opinion of D&P...Kennedy on SSN reiterates his views stating Administrators will "have blood on their hands"....D&P respond saying TBK's bid was not sustainable, no proof of funding for post June contract money, expenditure etc...

Then BOOM!! Kennedy's lawyers in email rip into D&P effectively calling them liars, asking for proof of these claims. Now, putting paranoia and conspiracy theories to one side, what are D&P up to? Is there a hidden agenda and what are they hiding? This saga has now descended into total farce. Whatever folks views are about TBK, Souness, Smith etc, from a purely business angle, what Kennedy made very clear in public today made total BUSINESS sense. I'm no administrator or businessman but you'd have to be blind, deaf and dumb to ignore their bid.

These other bids still require "due diligence" ie looking at the books. This cannot be done in the short time left. I would not be surprised if either neither bid is accepted or one is accepted then pulls out.

That and that alone is why D&P are up to something and CW's fingerprints are all over this!!

Simply put from a purely business perspective the Blue Knights bid was not the best available to the administrators. Rangers fans seem to be forgetting that the administrator's legal duty is to get the best deal for the creditors. Yes the Blue Knights would probably be the best bet for Rangers as an ongoing football concern but thats not what administration is about.

Plus there bid was a pittance and included revenue from reaching the 1/4 finals of the champions league. Heads in the sand?

Yes there is a hidden agenda, I have been saying this since 14th Feb. Whyte hurriedly arranged for Duff and Phelps to be appointed as administrators and they have been smoke screening ever since. They will only keep the club alive if someone comes in and buys out Whyte and has way too much money so that the creditors are paid in full. In the end Whyte will take the club in some guise to the third division, rebuild and sell it on at a massive profit. So lets stop kidding ourselves any longer, there will be no-one saving the club with the sort of money we owe people. It is finally game over.

I understood it would take d&p time to try to make sense of wtf was going on at our club all the while all they have been doing is stalling. Bill Miller was never going to buy Rangers! 2 no 3 no 4 unnamed bidders all ready to take over as of........... Emmm now. TBK/BK not sure what to think tbh. Seems to me they are the only real people with a real idea what's going on a nd have some money and plans on how to save us! Delusional. Look at a key area of the BK bid. Finance. They claimed 2 million would be put in the pot dependant on 'european success'. They will exit administration through a CVA. Yet, with research, they would find that a CVA is a change of company status and a change of company status carries a 3 year ban from europe under UEFA rules! Yes, RULES. D&F have to take the best offer for the creditors! NOT the fans. Get real.

Let me refresh your memories about the absolute farce that has been the "Great" Blue Knights bid for you. There first bid was rejected out of hand (i gather it was deemed an insult to the administrators and what they are trying to achieve (CVA and the rest) but okay it gets the ball rolling. They bid again. Rejected again. Not enough for CVA pot. They bid a 3rd time. They're Best and Last offer they say. Rejected not enough and the administration hint it also didn't give the necessary assurances, also had questionable conditions attached. The next bid is my favourite. The media widely report that Bill Miller is in the driving seat and is to bid in the region of 11 million. okay so The Blue Knights go in with an offer of around 8 million (ridiculous given its by then open to everyone that Bill Miller did infact bid just over 11 million) and again its without the assurances the administrators made clear they needed and (wait for it) its not in writing? SO now were at bid 4 and although the administrator have told all prospective bidders that they can only consider bids that are made in writing The Blue Knights bid is not infact in writing. Unsuprisingly the Bill Miller bid is accepted. Its at least 3 million more than TBK bid and has the necessary assurances to appease the administrators. Also its in writing lol. Bill Miller pulls out. SO do The Blue Knights, given the information at hand that they're offer was deemed too low and didn't give the necessary assurances, come in with a fresh stronger bid. NO they decide to go with the same bid that wasn't enough for the pot to get an acceptable CVA, AND put a midday deadline on its acceptance. COME ON GUYS! They all but leave the administrators no option but to decline they're offer. After reading Duff and Phelps statement after the "passionate" statement by Brian kennedy slating them, they feel they have no option but to go public to defend they're decision. It again tells you that The Great Blue Knights bid is without assurances (I'm now sick to death of writing "without assurances") and is again conditional. The guy Brian Kennedy has a brass neck if you ask me because as an outsider (Motherwell fan) it seems to me like you have been royally f*@ked about. Im not kidding. It may well be that this guy wants the best for Rangers and he might and probably would have been the best option for you but the way he went about acquiring Rangers Football Club has been amateurish and thats suprising to me as the guy has done well for himself and is obviously a good business man which just leaves me scratching my head even more at how he and TBK have conducted they're business. Ok i know the would have been trying to get it at a better knockdown price but even still. Poor show, and bad business.

It's easy to say he's brass neck but what has come out of duff and phelps to suggest anything they say is worth listening to? Bill miller was a good shout wasn't it? It's not about who 'we' want or don't want.

RFC is in Administration, a legal state, where rules have to be followed and the chief rule is getting the best for creditors.

D&P played a high risk strategy in trying to keep club going to sell as a going concern, to make it attractive to bidders, rather than the traditional route of severe cost cutting.

I could name lots of passionate fans, that doesn't make them realistic club owners. TBK's are hoping to pick up the club for a pittance, their thinking is that no-one else will actually follow through on bids. They will hang around like a bad smell and try to be last man standing. I favour the BK/TBKs bid. Why? Because I'm not a Rangers fan. They have no money and Rangers would be run on a shoestring for years. No players of note due to no descent salaries. They seem to be reliant on future income that is not guaranteed (Champs league). Sound familiar?
My only problem with their bid is the creditors get next to nothing. The face painter only gets £4 or less, the company that gave (sorry, supplied) Weir his going away present get about 40 quid and so on.

It is irrelevant where these companies are registered.
Rangers Football Club is a Scottish company.

English(England & Wales) law has no jurisdiction in Scotland so only Scottish Courts can deal with this issue. The original post was a wind up.

David Whitehouse, joint administrator, said: "The most important information today for Rangers supporters is that discussions with two bidding parties are at a very advanced stage and we hope to reach agreement with one at the earliest opportunity.

"We have noted today the publication of reasons for the findings of the SFA's judicial panel.

"We welcome the fact that the panel described the witnesses who appeared on behalf of the Club at the hearing as credible and reliable but as stated previously we were very disappointed that the panel did not differentiate sufficiently between the actions of the Club compared with the actions of individuals. One problem, Rangers are not worth 45 million, and the sanctions guarantee it will lose money for 3 years. Miller estimated 30 million to turn Rangers around, lets be generous and half his estimate to 15 million.

60 million investment with marginal returns after 3 years, is a difficult sell to anyone with their arms free.

Rangers: Charles Green-led group near takeover completion

The group in pole position to buy Rangers is fronted by former Sheffield United chief executive Charles Green.
His group joined the race to rescue the crisis-hit club last week when previous favourite Bill Miller withdrew his bid.
Little is known about the rest of Green's consortium but it is understood there are links to Singapore.
During Green's stint at Bramall Lane the Blades were listed on the stock exchange in 1997, but results on and off the field were disappointing.
He quit a year after the floatation and re-emerged in football shortly after as chairman of the football agency Proactive Sports. The Cheshire-based firm had a number of leading stars on its books, including Andrew Cole, Stan Collymore and Wayne Rooney.
But Green left Proactive in 2003 and has since held a number of directorships at medical science firms. He is currently a non-executive chairman of the Singapore-based Nova Resources Ltd.
There are currently four parties with bids on the table for Rangers, who have been in administration since February 14, and a decision on which bid will be accepted is expected on Saturday.
Singaporean businessman Bill Ng had previously bid for Rangers and was understood to have re-entered the race after American Miller dropped out of the race.

Ally McCoist revealed administrators are close to naming a preferred bidder for the club once again following the withdrawal of the previous preferred bidder Bill Miller earlier this week.

It is believed that Sale Sharks owner Brian Kennedy and his Blue Knights consortium are set to announce they will also be withdrawing from the process after having their bid turned down.

Administrators Duff and Phelps have been holding talks with two new interested parties and Green is thought to have emerged as the surprise frontrunner.

"I spoke to the administrators on the phone this morning and they are very encouraged," said McCoist. "They have told me they are very close again to naming a preferred bidder.

"There are two new potential purchasers who have come into the fray and I believe Brian Kennedy has been speaking to the administrators as well."

His Group may meet D&P's remit for creditors but he will NOT meet the remit for the long-term future of RFC. I am not being doom and gloom. As hopefully most regulars here know, my posts attempt to be objective and pragmatic. And believe me, my comments regards Green are objective!

If there is another player at the table, then are we to trust this is the Group consisting of "recognised names and RFC connections" as stated earlier this week by D&P.

By my calculation, TBK / Kennedy were approx. £2.7M short in their cash offer to appease D&P. I don't know exactly how many "Knights" are within TBK but if its 6 or so surely to God they could each come up with £400K each to beat Green?

Just had a thought fellow Bears.

I'm not completely convinced that finding someone with huge amounts of money to plough into the team is the best idea. Please hear me out before you castrate me.

My thinking is this:

David Murray spent millions of his own money over his spell as owner. Yes we are in a state now which some people believe to be his fault but look at it this way. What happened when he took his financial support away? It was through him that the bank provided us an overdraft facility.

What I'm saying is that if someone agrees to come in a plough loads of money into our club that will save us this time. But what happens if we don't change the way the business is run and they decide to leave as Murray did? We're right back where we started that's where.

I'm only posting this in the hope that people might stop going on about potential buyers wealth when trying to decide whether or not we want them in charge. Look at their business sense and decide from there because I feel that is the area we need to fix.

The reason TBK keep getting rejected is because they keep making offers which don't suit the creditors. Duff & Phelps are acting pretty much on behalf of the creditors and need to obtain the best deal for them.

Murray is more interested in protecting the debenture holders than offering a reasonable pence in the pound to obtain a CVA.

He's been kidding himself all along with his derisery bids and we need to wake up and stop getting on Duff & Phelps backs. I'm sure they are trying to obtain the best deal they can.

They after all accepted Millers bid and he done a runner the minute he seen the books. They're fighting a very difficult battle but it's one I feel they will win eventually.

TBK bid was never likely to be accepted.
Up the duffer without a paddle told us yesterday that BK's bid "could" be considered to be the 4th bid. This was always only a fall back if no other bid came in.
Now..you either believe D&P that there are another three bids on the table,and at least one of them is better than Brian Kennedy's. However i'm sceptical especially If Bill Ng's statement is true,- 30 messages on his phone,and told 50% of his previous offer would be good enough, i.e. £10 million. You won't get a cva agrement for that amount, if true this seems like D&P are desperate and panicking. Why panic if there are three other bids,and "two at an advanced stage in the hands of their lawyers" for the club?

Asfar as i have read its around 45-60 mil owed to HMRC not including the 14Mil CW didnt pay them this year. BRIAN KENNEDY and Paul Murray have been turned down in their bid to save Rangers.
after a tense morning of negotiations with administrators from Duff and Phelps, Kennedy has now been told the joint joint bid - believed to be worth in excess of £8.5m- cannot be accepted.
Kennedy and Murray are now expected to officially follow through on their promise to withdraw from the race to save the stricken club from extinction with a press conference being arranged for later this afternoon at an as yet unconfirmed venue in Glasgow.

The blue nights have pulled out again, short statement on news says the administrators rejected their bid. Kennedy says today was the deadline if a CVA was going to happen, that's passed now, chances of CVA now, slim to none - what do you ED and my fellow bears make of this now? It's crazy and embarrassing! A club this size being valued at 8-10 million and still can't get a buyer! I've posted a few times and never got on the page, hope this one makes it on!

It's not being valued at £11M that is regarded as the minimum cost of saving it. the £11M will be a drop in the ocean if HMRC say no to a CVA if the BTC is lost

Heres hoping there will be an end to all the uncertainty and false hopes we have heard since Feb 14th. All we want is our club to survive and stive on the park again. Sure mistakes were made previously which shouldn't go unpunished but for us and scottish football to flourish it needs us in the SPL. Lewis would be a great buyer with plenty clout and knowledge of the club..but why wait 'til now??
