Not convinced majority of Rangers fans truly want SFL3. fully understand the "gutted" comment but if every other SPL team voted "no" we can hardly describe them as "sheep". Such comments still suggest that many of our fans consider the rest of SPL as anti-RFC but if it had been any other SPL team who had broken rules/laws like we have, we would have been howling for their blood. I want SFL3 because we and the rest of Scottish football need to get back to our roots before the game in this country sinks for ever as a spectator sport.

Strange one from hearts, course they're welcome to vote any way they like and I for one won't have any hard feelings, but you'd think with them very likely to go to the wall next (or there abouts), that they wouldn't want to set a precedent. Saying that though, in a years time, if they're in the same situation, other clubs may vote them back in. So the little people want sporting integrity to be upheld, Dundee united showed a lot of integrity last year when they charge rangers fans entry for a rescheduled game that was abandoned.

Anyway like most Rangers fans I am sick to the back teeth of all of this, I firmly believe we shoiuld not put ourselves in the position where we will be judged by these people, its blood lusting ans vengance these people want.
We should take the descision out of thier hands and apply to play in the 3rd division.
They all say they dont need Rangers well lets find out, do Rangers need them and the way we are being treated.

Hibs fan here guys. Think D3 is the best way forward for Rangers but as others pointed out the likes of Spartans will be applying too so it's not set in stone you will be accepted. Find it pretty hypocritical that Aberdeen are attempting to maintain 'sporting integrity'. Given that in 1999/2000 they actually finished bottom of the league but were not relegated. If they had any sporting integrity they would have taken demotion to the First Division, regardless of the situation regarding league reform or the stadium facilities/capacity which the First Division Winner had.

I was talking to Alex Rae today on the train from prestwick airport to Glasgow central about the situation at club he said that when he signed he was told about EBT and was told that it was legal and had nothing to worry about he blames Murray for the whole mess that the club is in Alex is looking intO payin back what he paid into EBT and reckons other players will do it to

I'll bet he is.... and I'm surprised that most or all of the EBT beneficiaries aren't doing the same, especially those who consider themselves to be "Rangers Men", as sensible defensive action at appropriate times could actually have negated most of the EBT and Big Tax Case issues with minimal fuss, or certainly a lot less fuss than we've ended-up with.

I have several friends who are Chartered Accountants and have had several conversations with them about EBTs. My understanding from this is that an EBT is that they are fine as long as they are administered properly....

- the funds are basically pension funds, and as such it is fine for payments in to be made gross of tax and NI

- I believe professional sportsmen can generally be considered by HMRC to be "retired" at age 35, at which point they could then claim regular "pension" payments from the fund (and possibly even lump sums). Non-players (eg John Greig) could claim their payments from the fund at a reasonable retirement age, most likely 65yo but possibly less.

- It can even be acceptable for EBT beneficiaries to take an occasional loan from the fund, as long as it is subject to a proper loan and repayment agreement....

- .... but the key is that the trustees of the fund must be genuinely in control of it, and if requests for a loan are made there must be good reason (usually financial hardship) and the trustees must act indepently, being seen to objectively consider such requests (and often reject them).

What is very much not OK with HMRC is for much (most?) of an individual's salary payments to be made to the EBT and then paid out to the individual on demand soon afterwards, in the form of a "loan" that has no actual commitment to repay.

So my accountant friends tell me that, once it was realised that the cat was out of the bag re the misuse of EBTs at RFC and that HMRC would be seeking redress, they can't understand why someone at RFC or MIH didn't co-ordinate action to do some back-pedalling and damage limitation.... in a similar way to what Celtic did when they realised they were on dodgy ground by making Juninho's "golden cheerio" payment via an EBT. Celtic decided the only solution was to pay the tax due to HMRC and learn from the mistake for future.

Another timely example is Jimmy Carr.... he has been "outed" by The Times today for a tax avoidance scheme that is not unlike what was going on with RFC. But he has held his hands up, publicly admitted to it and seems to have made a commitment to sort it out. Jimmy will not be ending up in the same sort of bother that RFC have.

So it seems that the players wouldn't even have to immediately pay all the tax on the money, nor pay all the "loans" back at once.... they would simply have to agree a repayment plan for the loan, start paying it back, then once they clocked-up the retirement age (35 for a player, probably 65 for others) they could claim it as pension fund after all, with no HMRC problems for themselves or RFC.... they would eventually get all their tax free money, even if they had to wait a few years longer than planned.

As the funds are Jersey-based HMRC have no redress against them directly but can hold either RFC or the beneficiaries (players etc) jointly or severally liable for the Income Tax that is seen to have been avoided.

Now that RFC have gone into liquidation there is next to no chance of HMRC being able to reclaim any of this from RFC (Oldco, in liquidation) nor from Newco (a fresh and distinct legal entity).

So that leaves the EBT beneficiaries (players) as the last men standing, and sooner or later they will all be hearing from HMRC.

So it seems to me that with some firm and timely action (and a few awkward conversations) from someone at RFC or MIH this whole EBT/ Big Tax Case could have been minimised, with RFC liable only for the Employers NI payments and the players themselves "cleaning up" their EBT loans by making repayment commitments, then eventually getting their money at retirement, still tax free.

In other words, the Big Tax Case need never have happened, and RFC (but for the madness of Craig Whyte's activities) need not have gone into liquidation.

If anyone knows better, feel free to put me straight on this.

And it may well turn out that they recognise he was an innocent party badly advised and waive some of it. The important thing is for everyone in his position to be just as honest, so that the true facts about Murray and others are exposed.

There are 2 sure things in life.... death and taxes.

HMRC want their money from someone, especially to set an example to football in general.

RFC are in liquidation so HMRC's next port of call is the EBT beneficiaries themselves, who will be jointly and severally liable for the tax debt.

If any of us as individuals were found to have underpaid our tax we'd be getting a letter from HMRC, these players are no different, they can't hide behind "it's not out fault, David Murray did it...."

Since the HMRC have effectively found against RFC already (FTT outcome that is due is actually RFC's appeal) and also because the case is now very much in the public domain I think it is unlikely that the players can get away with simply beginning to repay their EBT loans.... that might have been a simple solution at a much earlier stage in the process but it's probably too late to try that.

So players will be speaking to their accountants, and being advised that they may be better to pay up soon to avoid penalties.

Trying to fight the case has cost RFC millions in penalties, an uplift of about 50% over the amount of tax due, the players won't want the same treatment.

The players second contract protected the player from the club having to pay it back that contract was illegal and also states that it was part of their salary which makes it tax deductible i dont see hmrs allowing an illegal contract stopping them from going after the players they will probably have to pay up and then try to sue the club that has gone into liquidation remember the club did not deduct the tax so it will probably fall to the player

I understand what your saying, but im pretty sure the players themselves (employees) can not be liable for taxes due and lies with RFC (employers). I dont even think they will be able claim the owners (murray & whyte) but if fraud, they may punished with a ban from running a business or jail but I doubt it.

I don't see how the beneficiaries of EBTs can claim everything was ok. If I receive payment outwith salary it has to be taxed accordingly. I have no doubt they were mislead by Murray etc, but their accountants and agents should have been protecting their interests and advising them the tax man may consider the payments as taxable income, even at a later date.
It was not paid into a pension fund, it was paid as a loan from a trust, that did not require the money to be paid back. It's a tax dodge and must have seemed dubious when it was suggested. Of all the beneficiaries who received payments, none questioned EBTs' legitimacy?

Scottish football was at its strongest before murray and souness came in with the millions and wasted our game. You will go to Div 3 because all the fans of the HONEST clubs are demanding it and their chairmen wont dare go against their wishes as it will cost them more in the long term. And any club which votes for the newco will be boycotted by all fair minded fans throughout the country. This is nothing to do with money its about our sporting integrity and for once to stop being the laughing stock of european football. The fans are having their say and your club is going to the wilderness where you belong and getting a just punishment for the cheating, deceipt and lying you have done through the years. A little bit of remorse or even some sort of an apology may have saved you a while back but that ship has sailed and yours is about to be sunk for good. Scottish football will get back to the good years of the 80s and you wont be part of it.

So you are in favour of the return of dodgy taches, male perms, serious soccer violence, major and open sectarianism and racism in comparison to today, 'poorly' estimated attendance figures (tax evasion not tax avoidance BTW - ten times worse morally and Celtic weren't the only club doing it in case you think its a dig), fewer women and children in attendance with no family enclosures as we know them, horrendous pitches, ramshackle stadia, and players forced to sign ten year contracts? No ta, you are welcome to it.

Seriously though. The players were better, but where are you going to get the money to produce teams who are actually good enough to compete on the European stage year in year out as Aberdeen and Dundee United once did? Maybe in a decade or so IFF league reconstruction comes in and there is a FAIR split of the generated income within the game which allows ALL of the clubs to promote and nurture their youth players effectively and in unison our game may improve (we can only hope). On a similar tact the SFA will also have to concurrently invest heavily in a way that will get children outside playing football and away from x-boxes and PS3's. How many of the posters on here let there kids go to the park (if there are any left in your area which is yet another problem to overcome as the government certainly won't invest in sport with the economy in the mess it is in) with their mates to play footie until it is dark like they did in my/our day? Hardly any I would bet and that is just as big a part of the overall problem in my opinion. Otherwise you are in dreamland if you think the game will miraculously improve once Rangers are gone from the SPL, it will most likely go backwards rapidly and stay there unfortunately if the above issues aren't addressed quickly. Celtic will have a stranglehold of the game as they are the only club with genuine financial muscle and most supporters, including Celtic's, will get bored with it quickly enough and stop attending once the gap widens even further.

Another thing whilst I am on a rant. The 'sporting integrity' and 'morality' lines being spouted continuously on here are starting to wear thin as you are, in the majority of cases, already preaching to the converted. To me it is like Cameron (who's father actively promoted tax avoidance schemes ironically enough) singling out Jimmy Carr (non-Tory supporter using a 'legal' tax avoidance scheme) and giving Gary Barlow (Tory supporter also using an equally 'legal', yet slightly different, tax evasion scheme) a free pass in terms of their respective moral compasses. Skeletons are in every boardroom's cupboard within Scottish football and 'morals' and 'sporting integrity' are wheeled out only when it suits the agenda. Do you HONESTLY believe any, and I mean any, of the chairmen would have voted 'no' if there wasn't the hullabaloo currently created by the fans? The fans have spoken and with the threat to their bank balance from both sides they are erring on the side of caution and are taking the lesser of two evils. If the fans hadn't (quite rightly) kicked up such a fuss what do you think would have happened? They would have taken the money option every day of the week and twice on a Sunday as they are businessmen first and foremost (probably with accountants who 'legally' limit how much tax they pay personally themselves) and would only have been interested in the bottom line, not 'morals' or 'sporting integrity'.

It is us the fans, myself included, that want to see a morally just game built upon sporting integrity and the fan reaction to a potential 'yes' vote may have secured the correct decision on this occasion. I applaud all non Rangers fans for that but read back the posts on here. The vast majority of Rangers fans have said for months that Div 3 is the way forward for the club as we deserve to be there for what has gone on (indeed we should be grateful that that option is even still open to us).

Sporting integrity and football have never even been in the same room together let alone bedfellows (DiCanio when he played for West Ham and refused to score a goal as an opposition player was injured is about the only positive example of 'sporting integrity' that I can think of). The vote will be a resounding 'NO' and, as I said, I will applaud that result, but give it a rest with the 'sporting integrity' being upheld by these 'moral' champions who represent your clubs. It is a utopian ideal that has never truly existed within the game at any club as far as I have seen. When is the last time you heard a manager, or a chairman for that matter, come out and openly criticise a player for diving if his team had gained an advantage from it? Exactly. Some Rangers players are considering not returning to the club for pre-season training, because they believe it may undermine their position if they wish to object formally to their contract having been transferred to Charles Green's newco.


If the Transfer of Undertakings Protection of Employment procedures have not been properly followed, then the players could take legal action against the newco for 13 weeks' wages, a claim that could amount to £5m in total if all players decided to act.


In an interview on Rangers TV yesterday, Green said that the players' contracts had been transferred to his newco last Thursday, when he bought the business and assets of Rangers Football Club plc. However, under TUPE regulations, staff must be given reasonable notice of the transferral of their contract, to allow them to deliberate, take advice and then decided if they wish to object or not. It is the belief of PFA Scotland, who have been seeking the advice of a QC, that this procedure wasn't followed, and so the newco is open to a legal claim by the players.

"A failure to comply [to TUPE regulations] can result in the recognised union, as is the case regarding the players, seeking a protective award of 13 weeks' pay for each affected union member," said an employment law specialist. "The union would have to raise a claim for a protective award before the Glasgow Employment Tribunal to argue there had been a failure to inform and/or consult with them regarding the affected employees."

Most of the players are angered by Green's failure to speak to them before transferring their contracts. There has been no dialogue with them or their agents, although Green said yesterday that he and manager Ally McCoist will meet the squad when they return for pre-season training on Thursday. However not all of them may turn up. If any are considering rejecting the transfer of the contract, and so wish to leave as a free agent, then turning up for work may prejudice their case. The same would apply to accepting wages, which are also due to be paid on Thursday, although there are serious concerns that Green's consortium has the funds to meet obligations.

"If a player has not formally objected to the transfer before they receive their first wage from newco then there is a risk they may be deemed to have acquiesced to the transfer," the employment law specialist said. "The length of time which has elapsed between the transfer [sale of assets] and the date on which the wage is paid could be a crucial element here.

Been through this process twice,in last 23 years. It is there to protect the employees to a degree for a period of upto 12 months after transfer.
There is nothing to stop employees terminating their contracts,i.e. resigning.
I think the issue rests with the T&C's.
If reduction of wages is being mooted,then this is a change to original contract,and players could either walk away,or take legal action. Either way, bad news for new owners.
Only solution wold be that we remain in SPL and current salaries are maintained .
Any deviation could be challenged as a change of T&C's to present contract.

I know a relative of one of our younger players, not naming him but played last season in defence for a few matches. He has been assured by the new owners that all the players will be paid their full wages and will receive full back wages owed and all the bonus money they did not receive last season. Being reported in Daily Mail that SFA may have put a deal together which will see us in SPL then immediately demoted to div one for dual contracts.

Seem to think that will keep Sky happy, UEFA happy and the fans of other clubs relatively happy.

Suppose if that means one season in div one, it could be worse but still not great. However it would bring the whole sorry episode to an end. This is probably as good as we can expect or hope.

I for one would be ok with this if there is no points deduction when back in SPL, and that finally dealt with the lot.

In response to the rumour it seems there are too many hurdles for a single division drop to work, the views of those in the lower two division for a start. I wish an embaro could be put on the media who are milking this story for all they can. Yes it's a major story but the spurious headlines are there to sell papers. I can't agree with the SPL clubs having a vote. If there are rules broken then punish, if not, don't. Tell a Rangers fan that rule was broken and that's the punishment and he'll accept it. Two problems mutually exclusive of each other -
1) The ONLY Rangers that can be demoted is oldclub.
2) newclub should not be punished for oldclubs wrongs, AND as a newclub cannot waltz into the top tier, or join midway through the league structure.
It's an SFL3 start for a newclub, and even then they will have to wave to need for audited accounts.

People keep on merging oldclub and newclub, they are two seperate enitites.

Rangers owner Charles Green is putting together an ­emergency plan to move the Glasgow giants to ENGLAND as he battles for the club’s future.

Green has bought the Ibrox outfit and is taking them out of administration, hoping to persuade Ally McCoist to stay on as manager.

But there are huge doubts about whether they will play in the SPL next season, or be forced to drop to the fourth level.

And insiders close to the Yorkshireman’s camp reveal that Green is lining up an ­astonishing bid to buy a lower-division club in England and take their place in the Football League instead.

Green, formerly chief executive of Sheffield United, would have to clear several hurdles to make the move possible, but he is actively investigating the scheme.

The plan would see Rangers try to climb the divisions in England yet continue to play their home games at Ibrox, their Glasgow HQ – their large support will always follow them over the border.

The Mirror has learned that League One club Bury are in Green’s sights, as they could be bought for a modest sum and present Rangers with a place in English football.

Bury chairman Brian Fenton said on Wednesday night: “We have had no contact with Charles Green or Rangers Football Club.”

Green and his ­financial team have , however, been looking at Bury in particular – although the historic move would cause outcry at many levels.

But the rewards for Rangers are great if they can switch to England as they would have a great chance of rebuilding in a new country’s league.

Rangers will find out at the start of July if they are to be readmitted to the SPL.

Scotland’s top-flight clubs are voting on their fate.

If the once-mighty club are snubbed it may speed up their own escape bid and the gloves would come off as they take on the authorities to make it happen

Unless they have move there home ground INTO England it can't happen.
Check the UEFA rules - you need to play your home games inside the country. They changed the ruling to make it clear it can't ever happen. Present cases excluded ie Swansea, Cardiff, Monaco etc...........kbt1978

I think this idea may be a non starter. The Welsh teams play in the English League because there isn't a professional league in Wales.

The Scottish leagues are professional, so that rules that route out. I think that buying Bury and doing away with them, would cause an outcry in England. They may not have the history of Rangers......but they still have history.

Also Rangers are a Scottish club from Scotland. How would this affect the national teams and leagues? They could pretend to be English....but their not!

Then you've got the new problem of independence for Scotland. SNP want Scotland to vote for complete independence from UK in 2014. How could a team based in an independent Scotland play football in a football league in the United Kingdom.

Personally I hope this is true. Rangers in England could see us rival Chelsea and united. We have the support, the stadium, training facilities and with a bit of the tv money England has we could sign top players.

Even if it were true, it's not a forgone conculsion that Rangers would rise up to the PL in consecutive seasons. Leeds, Leicester, Nottimgham, Sheffield - all large cities with one or more well-supported teams not in the PL.

For long, the financial differences between the football leagues of the two nations have been humongous. For instance, the team finishing bottom of the Championship will still receive more in television money than that which wins the SPL.

To that end, a move to England has always looked incredibly lucrative for Scottish clubs, in particular the Old Firm.

However, if true, it seems that Green is looking to get these wheels into motion.

It is reported that Green's preference would be to stay in the SPL sanction free, and it would appear as though this move to buy up an English outfit is merely a long-shot alternative to a drop to Division Three; a drop that would quite frankly prove financially disastrous for the club.

The rumoured target of the buy-out is League One side Bury, although their chairman, Brian Fenton, has denied any contact with neither Mr. Green, nor Rangers.

In the event that such a move would go ahead, many Rangers fans have already expressed their reservations about being responsible for the demise of a fellow footballing club, merely for their own club's gain.

A club from England cannot play in the SPL as they would need to move here, just like Rangers can't play in any of the English leagues because they would have to relocate to English soil, have a stadium down there. To be perfectly frank, swapping with whatever division it is Bury play in is preferable to coming back to the spl sanction-free, let alone going anywhere else. The charge was (and is) in relation to the oldco. The assets of that oldco (ibrox, murray park, albion car park) have been legally sold by the administrators to Sevco Scotland Ltd, and thus the charge now has no provenance whatsoever in relation to these assets.

Any income from assets sale after fees are deducted go to the charge holder first and then any surplus to the liquidator for distribution of dividends. CW needs as much as he can to be able to pay Ticketus - won't happen due to massive shortfall.
