friday is the day liquidation happens, all cva proposed bids will be rejected and club 9 sports are already in place as preferred bidder, with liquidation there way ahead, hybrid liquidation is what im hearing from legal people up here, which is basically liquidating the debt/creditors but keeping all the history under a new name and spl licence, this is where st mirren come into it

Bears - a wee bit off topic but this is something that I have thought about for a while and I would like to get everyone's Opinions.. The current situation is a mess, no doubt about it. David Murray went for the Champions league and didn't get the level Of success required to break even with his investment. Every time I look back my mind goes straight to one game which I believe is one of the most defining nights in our history - Bayer Munich away. The night mols got injured, we hit the woodwork about 4 times and played Munich off the park. I honestly believe that was out moment and we never took it. When you look back that's when things started to go downhill. If we had won that night or drawn to get through, I honestly think out financials over that period would have been a lot better and who knows where that team couldve got to that year. What's your thoughts boys? It's a night I will never forget and I know lots of Bears that feel the same.

Totally agree mate - this should have been our night. We played them off the park at Ibrox in the first game as well and they got away with a point.

We had one of the best midfields in Europe that season - van Bronkhurst, Albertz, Fergie and Reyna. If only wee Mols had stamped on the big German keeper.

All went wrong when we sold Alberz, van Bronkhurst, Tugay, Reyna and McInnes and bought big Bert Konterman to replace them all!

Was speaking about that game to my pals on Friday at the game. We were fabulous in both legs and were unbelievable that night in Munich. Without doubt Mols was top class and that night he took a bad one, and was never quite the player when came back.

For me it was just after the 93 champs league final where marseille beat ac Milan 1-0, we learned afterwards that marseille cheated and paid cska Sofia to conseed the six goals they needed to stop rangers getting to the final. Marseille were stripped of that title banned from Europe but the powers at be would not replay the final between rangers and ac Milan. For me that's where it all started and it became David Murray Obsession to win champs league after that....

Rangers owner Craig Whyte has filed legal documents protecting his hold over the club as the battle for control of Ibrox looms.

The debenture document registered with Companies House gives Mr Whyte's company Liberty Corporate Ltd a new fixed and floating charge over Rangers FC Group - the parent company that owns the football club.

Liberty Corporate sole shareholder is Liberty Capital Limited, which is owned by Mr Whyte and registered to the British Virgin Islands. His father, Thomas Whyte, is the sole director of Liberty Corporate.

The document is dated March 21, 2012, two days before a key court decision that saw administrators battle with Ticketus over the deal Mr Whyte struck to sell off 100,000 future season ticket sales at Ibrox for £25.3m.

The new charge means Mr Whyte holds key powers over the parent company in the battle for control of Rangers, which is likely to come to a head this week with administrators revealing their preferred bidders for the club.

Crucially, the new document signed by Mr Whyte covers Rangers FC Group’s main asset – its 85% shareholdings in playing club, Rangers FC plc.

Mr Whyte's status as fixed and floating charge holder would put him at the head of the queue to benefit from the proceeds of any sale of these shares. Unsecured creditors and any other shareholders in Rangers FC Group would only receive payment after Mr Whyte's company.

Mr Whyte's position is not guaranteed if Rangers FC Group went into liquidation in the next two years, because the new charge might then be struck down, although that would likely be the subject of a lengthy and expensive legal battle.

All we seem to hear on this site, not that it is a shock to the vast majority of decent people, is who wants to shaft as many people as possible. Craig Whyte has undoubtadly done the nasty on all the supporters, SDM has done similar but over a longer period and in turn made Scottish Footabll the laughing stock of World Football. The Scottish media have been supporting SDM, the Old Board, Smith,Bain and Coisty and the snake oil salesman CW myths, lies and misinformation for over recent years and have shafted the supporters in holding back the truth of the perilous situation RFC have been in for a decade. D&P are running up huge bills and as part of the original team that helped CW it is incredible to think that they have been appointed as Administrators, shafting the season ticket holders and genuine fans.The "new" Bidders (again smoking mirrors and misinformation) are in various degrees going to shaft the Club and supporters and worst of all for many of us the WATP brigade and their are tens of thousands of loyal fans want to shaft the good people of this country by openly and regulalry promoting the idea that no debts, particulalry the BTC, wee TC and the 9 months of non payment of tax and NI should be paid, not to mention all the other small comapnies who are waiting to paid and never likely to get paid for the services and products provided to RFC.... No it does not. It means that in a CVA or liquidation Whyte will claim to be a prefered creditor. This will almost certainly be challenged by the other creditors, the money for the legal bills coming from the Rangers corpse. The only winner in this are the Lawyers

“We can confirm that representatives of Club 9 Sports have been involved with investigating, analyzing and considering a potential purchase of Rangers Football Club, plc on behalf of a group of interested parties from the US and UK. However, at no time has Club 9 Sports itself offered a bid to acquire the club. Our role has been as a member of a proposed consortium. We can also confirm that we have not met with, spoken to or otherwise been associated with Craig Whyte in any way.
Furthermore, Club 9 Sports will not be bidding for control of Rangers Football Club, plc. We understand that it has been strongly rumored that our group planned to “liquidate” the club. It should be made clear that any party that attempts to acquire the club, eliminate the debts, affect a turnaround, invest monies and put the club back on solid ground is in fact “saving” the club from liquidation and preserving its past and its future. In an asset purchase, all of the good and valuable assets (records, marks, names, trophies, players, staff, history) are preserved and separated from the bad and harmful liabilities (tax bills, bad contracts, creditors), which have put the club into administration and which act to force the entirety into liquidation. By putting all of the assets into a different corporate structure, the assets are in fact rescued from liquidation. Such a transaction would be very similar to the one that occurred at Leeds United in 2007, which simultaneously rescued that club, maintained its proud history and allowed the club to shed its debt burdens so that it could have the opportunity for future success.
Finally, we would like to acknowledge that any successful bidder for Rangers will indeed need to embrace the legendary fan base of the club and communicate with openness and regularity. Tranmere Rovers were contacted by the Chicago-based investment company about a proposed takeover last February.

Chairman Peter Johnson was looking for buyers for his 60 per cent stake in the club when he met Club 9 officials — who’d failed to take over Sheffield Wednesday the year before.

But fan power saw Johnson forced to abandon hopes of the US company becoming involved — amid claims they’d make Rovers the football equivalent of a Kentucky Fried Chicken outlet.

They also humiliated the League One outfit by putting them up for sale on EBAY!

Scot Andy Doyle, chairman of the club’s supporters’ association, said: “Rangers should chase these people out of town. One look at their website should tell you what they’re about. They’re not interested in sport in the slightest, only asset-stripping.

“When their interest in us became public, everyone was asking the same question — what’s an American company with $900miilion turnover doing interested in little old Tranmere, where we’ve a turnover of £2m?

“We started asking questions and the answers we got were really alarming. We have fans in the US and some made contact with a newspaper in California. It turned out that members of the board at Club 9 had been indicted on fraud charges.

“When they were linked with us, they HUMILIATED Tranmere by putting us up for sale on eBay.

“They made us a laughing stock. You’d opposing fans bidding ten pence. Club 9 tried to claim it was a mistake and a publicity stunt but no one believed them.

“Essentially, their plan was to open us up as a franchise. They’d put one of their people in place, charge £45,000 a month in management fees and we would become a glorified Kentucky Fried Chicken.

“It’s exactly like the Glazers at Manchester United — they’re interested in what the club’s worth, but there’s no indication of them putting in money up front.

“The attitude was ‘hand over the keys, we’ll look at your bills but there’s nothing in the way of a transfer kitty or investment.’

“They’re only interested in what the club can do for them, not the other way about.”

Doyle says fan power ended Club 9’s hopes. He added: “The fans caused such a stink their interest was quietly dropped.

“A couple of weeks ago there was a suggestion they were renewing their interest in Rovers, but I can’t see it ever happening here and it shouldn’t happen in Scotland either.

“It was significant that when they wanted in at Tranmere they only met the club hierarchy. They weren’t interested in meeting supporters’ groups.

“They said they would meet us — but only after they had control. They didn’t want anyone asking awkward questions.

“The strange thing about Tranmere is that, unlike a lot of clubs, although we’re for sale, we’ve not got much debt.

“We’re not in bad shape and I think this was what interested the Club 9 people.

“The bottom line is that they’re not good news — they weren’t for us and they won’t be for Rangers.”

Right bears we've reached a time in our history where we are desperate. desperate for a resolution......desperate for a saviour!! I still hope the blue knights manage to gain control of our club because no matter what anyone says these men are indeed "rangers men" n im certain the interest of the club n its history n tradition will be as important to them as it us to us but......i also get the feeling that the blue knights consortium are the poor relatives in the bidding process so whos the next best thing?? I'd have to say brian kennedy. i cant believe a man who is said to be a last resort would make the first concrete offer n then as a deadline is set by D&P his name pops up again. so this is what im suggesting fellow fans....we have shown our support through the bums on seats at every game since administration n through the rff, we have pumped money into the club but where will our money end up? Sorry to rain on your parade but I don't understand what, if anything, you actually think this will achieve.You do understand that the administrators main job is to the creditors, not the club, not the fans, not the history or anything else. They are obliged by the courts to accept the best possible deal for the creditors and this is the only terms that any bid will be considered upon. In an ideal world I'm sure they would like to get in and out with minimal fuss and with the fans onboard but as I said that is not their job, their legal duty is to the creditors and them alone.

Duff and Phelps are now making enquiries with the SFA and SPL regarding liquidation of Rangers. They started off by stating they didn't think we we would be in admin long, then a CVA would be achieved and in the past week or so they began talking about liquidation, now they are actively discussing it with the football authorities. Let's face it, no one has told us the truth from day one. It looks like we have been fecked good and proper and no amount of the fans telling the new owners, whoever they are, what we want it will make no difference at all. Like all fans, including the manky mob, Murray et al are only interested in our money and not what we think. Even the RFFF is screwing us over, how much money did Jardine put into the fund, a man who has been rude all his life to fans is now begging for our money. Great player or not, he should not be employed at Ibrox. As much as I hate it, maybe the times have been right all along.

I have met Sandy Jardine on a number of occasions and found him to be courteous and a true blue - am not having a go because you must have had a different experience but at a time like this we should be rallying round the people who care about the club as much as us. Liquidation although being possible is not inevitable what will turn it into the latter is if we start fighting amongst ourselves and not putting our trust in the people (Smith, Mccoist and Jardine to name a few) who do love and care for the club as much as we do. To say that these people don't is utter utter nonsense. Turn your anger and demonstrations to the few men who have allowed this to happen to our Club , Craig Whyte and Sir David Murray and the suits who are trying to gain control of the club for their own means and that does not include Paul Murray or Brain Kennedy as I believe they are trying their damnedest to save us.

CVA, CVA, CVA that all I hear, but if you think about it, what is a CVA? and how will it work?

Its means Rangers debtors will agree to a repayment of debt over a period of time, thus keeping the club afloat, but typically the debtors get about 50% + of their money back or its not worth it for them. As Ticketus is effectively a debtor too, the debt mountain must be 100 million at least and no scottish club could survive that !

So for the next 10 years rangers will pay back 50 million+ that about 6 mill each year and still pay players salaries with no european football. Look at Leeds United did the same 10 years ago and are now 2 divisions below the premier league and cant get back up they have to sell any decent player they get to keep the debt payments going.

That's why liquidation is the best option, keep the ground the badge the name Rangers 2012, lose the debt and within 3 years back in Europe debt free. Football is a business and had SDM ran it as a business Rangers would not be in trouble today! Its like the old saying "winning isn't everything", staying afloat is more important. To think that Flo got 12 million makes yer blood boil ! And all the greedy directors getting their bonuses tax free now Rangers has to pay their tax too! makes yer blood boil.

Craig Whyte was brought in to do a job that SDM or Paul MUrray couldn.t do and that to liquidate rangers and start a fresh, 20 years from now it wont matter

If you look at the world at the moment it is all about staying afloat, Ireland borrowed billions of the tax payers money Greece did the same will we ever get the money back? Only time will tell. There is a rumour from one news outlet that Kennedy will put in another bid tomorrow. His first bid was only offering a couple of million and rightly dumped by administrators. He is a backup to TBK to generate interest and give some kind of competitiveness to the bidding process but he is not going to get the club. No where near enough money.

Rangers have been told they have no chance of gaining approval to play European football next season, STV understands.

It is understood that the Ibrox side have already been informed by both the Scottish FA and UEFA they stand no prospect of playing in Europe, with the club’s administrators having participated in a conference call with the governing bodies last week.

The club claimed on Tuesday they had submitted an application for a UEFA Club Licence ahead of the deadline on March 31, despite failing to meet two requirements in the guidelines.

It is understood however that clubs do not even apply to the Scottish FA for a licence. Instead, the powers that be at Hampden assess the suitability of all potential European competitors based on the information they submit in their application for a national licence, as well as any additional paperwork sent in required to meet UEFA criteria.

STV understands Rangers’ administrators hoped they may receive special dispensation, should the ownership of the club change hands and come out of administration in the coming weeks.

Despite their claims, the Scottish FA are adamant the club would not meet the criteria for a licence.

A failure to produce audited accounts by March 31, as well as the failure to meet overdue payables to the tax authorities due from up to December 31, 2011 by the same deadline, means the Scottish FA will not give their approval for them to participate in Europe in 2012/13.

Rangers went into administration on February 14, having failed to meet PAYE obligations for players and staff of around 9m.

If Rangers do not gain a licence and finish second in this season’s SPL, the Champions League position will be given to the side which comes third. The team which qualifies will enter at the third qualifying round stage on the non-champions path.

Rules

Article 47 of UEFA’s Club Licensing Criteria states states: “Each licence applicant is required to provide a copy of its audited annual financial statements as defined in respect of the statutory closing date prior to the deadline for submission of the application to the SFA and prior to the deadline for submission of the list of licensing decisions to UEFA. Audited financial statements must include the auditor’s report. The auditor must be independent as defined in Annex 01 / 01.1 of Part 4.”

The Scottish FA requires clubs to forward a copy of audited accounts to them by March 31.

Article 50 refers to payables overdue towards employees and social/tax authorities and states: "Licence applicants must demonstrate that as at 31 March 2012 they have no payables overdue towards their employees or social/tax authorities as a result of contractual and legal obligations towards their employees that arose prior to 31 December 2011."

FAO Duff & Duffer Rangers will not under any circumstances be playing in Europe next season. Stop taking the piss out of the bears!

First off, he describes the story flying around Glasgow, that he has agreed to sell his 85 per cent stake in Rangers to Paul Murray, as “absolute crap”.
He said this was not about to happen and reiterated his point, made to me some days ago, that he is not about to walk away from Rangers without the 30m he is owed for his stake.

My understanding of this situation is that it's the SFA's preference to have audited accounts submitted by the 31st March and not EUFA's.

I think EUFA accept accounts up until June of each year. The SFA and in particular, Stuart Regan, has done "NOTHING" to assist Rangers in any way since we entered administration.

I'm sure if Rangers could manage to submit accounts in the next few weeks, the SFA, or Stuart Regan, would do nothing to assist us in submitting them to EUFA, in order to give us a chance.

I wouldn't build up my hopes. The guys from the Far East and the USA are vultures who will not put capital into the club. They will consider a purchase/liquidation scenario. The White Knights will also be forced into that scenario. I fear liquidation is inevitable and just around the corner. I'm just being realistic.

Paul Murray now reduced to pleading for Craig Why to give up his shares in Assets which MIH books had listed as £150m on the balance sheets recently.
Murray needs to get less emotional and find hard cash not rejigger debt over longer periods.
Murray currently is not a fit and proper person to be an office holder of an SPL club under SFA regulations. This doesnt just go away.
The legal requirement of Administrators is to maximise returns for Creditors. Nothing else.

As long as Rangers are invited back into the SPL with 3 years of point deductions, then liquidation is the best scenario.

If liquidation means starting in Div 3 then its not a viable option, RFC is structurally too big to streamline and downsize for the lower divisions.

There is one thing clear, there is no quick way out of this can of worms and fans should be mentally prepared for at least a 5 year recovery period.

I still believe Rangers is worth more to creditors under a CVA than liquidation, but its a close call.

I cant believe some Gers fans on here dont care about our history, and are only interested in seeing millions getting spent on a newco. And the rest moaning about the ticketus deal when the clearly didn't read the details of it or understand the details. So lets make a few things clear.. Ticketus would have been our biggest creditor, but now they are with us we dont have to worry about that wee problem....Ticketus will be paid part of the money owed but over a longer period, thats a relief, Ticketus being on our side now means we have much less to be paid so that we can be in champs league qualifiers next season, which I think can still happen....Ticketus will cover our running costs just like banks would for any other club, which is normal as they would be paid back come season ticket time.....Most importantly Ticketus paid off our 18 million owed to the bank, it would be wrong to shaft them, and mabe we are lucky they still want to help, albeit this way they can get some money back by going down this road. Ticketus are owed £27m by Rangers and have agreed to reduce that to £10m should the Blue Knights gain control of the club.


This amount would be paid over nine years with no repayments at all in the first two years. Rangers would then pay approx £1.4m per year over the remaining seven years but only if Rangers qualify for European football. There are no repayments in any year that we don't.

There is no interest charged on the £10m.


Additional Working Capital

To aid the club through the next few years Ticketus will provide a £10m facility to fund operations.


Legal Proceedings

Rangers FC will not be pursued by Ticketus over any outstanding monies by they retain the right to pursue other parties regarding any losses they may have incurred.

It will open the way to the option for the Blue Knights to purchase the club via a CVA and hence avoid liquidation.

You missed out one important piece of information, how much is the consortium offering for the club ?

If the bulk of their offer is simply writing off debt then what are they offering the creditors ?

27m down to 10m equates to around 37p in the pound.

If the other creditors are not offered a similar level of renumeration then they could vote the CVA down.

Assuming HMRC are owed 70m then on this scale they would need to be offered 26m, which is a sizeable chunk of cash.

Ticketus are currently not Creditors. They are contract holders.
This deal does nothing for Creditors/ HMRC. It is D&Ps job to primarily look after Creditors. NOT rangers or fans notions of history, it's about money.

Hence the reason Murray is surprised D&P haven't already started this process. Tomorrow's media will have some details of the deal negotiated between by Paul Murray and Ticketus on behalf of the Blue Knights.

It will be incredibly good news for Rangers.
